Henan Telecom Regulations will come into force on January 1, 2021. Below, I would like to introduce to you the background and process of the formulation of the Regulations, as well as the main contents.
First, the background of the "Regulations"
Telecom industry is the leading industry and pillar industry of national economic growth. In recent years, the telecom industry in our province has shown a healthy development trend, the overall economic operation is good, the total business volume has grown rapidly, the investment in 5G has increased, the network capacity has been continuously enhanced, the scale of users has continued to expand, the development of converged services has accelerated, the speed-up and fee reduction have been solidly promoted, and the consumption flow has accelerated. By the end of October 2020, the total number of mobile phone users in the province reached 109.176 million, ranking third in the country (including 13.947 million 5G users); The total number of Internet users in the province reached 118.04 million, ranking fourth in the country (including 30.812 million Internet broadband access users, ranking fourth in the country; There are 87.228 million mobile Internet users, ranking third in the country). The penetration rate of fixed broadband households and mobile broadband users reached 102/100 households and 89.4/100 people respectively. The proportion of broadband access users over 100M is 98.2%, ranking first in the country. In the first 10 months of this year, the total telecom business in the province was 692.92 billion yuan, ranking third in the country, with a year-on-year increase of 35.5%.
The continuous evolution of information and communication technology and the rapid development of telecommunications industry have greatly promoted the development of related industries and provided all-round and multi-field communication and information services for the province’s economic and social development. Telecommunications has become not only a tool for people’s daily communication, but also an important carrier for payment and settlement and identity authentication, and a powerful support for the transformation and upgrading of traditional industries, digital economy and economic and social informatization. At present, with the rapid development of the telecommunications industry, the existing relevant laws and regulations in our province can no longer meet the needs of the new situation, and the modernization of the telecommunications industry governance system and governance capacity is in urgent need of legislative protection. In order to promote the development of telecom industry in our province, standardize the order of telecom market, protect the legitimate rights and interests of telecom users and ensure the security of network information, it is imperative to formulate the Regulations.
Second, the process of formulating the Regulations
Since the Regulations were included in the Local Legislative Plan of the Standing Committee of Henan Provincial People’s Congress for 2018-2022, according to the planning requirements, the Financial and Economic Committee of the Provincial People’s Congress and the Provincial Communications Administration actively carried out the investigation work of the Regulations (Draft), and went to Guangdong, Hainan, Beijing and other places to carry out investigations, and at the same time, gained a deep understanding of the outstanding problems existing in the information and communications industry in our province, and listened to the relevant departments and basic telecommunications enterprises in the province many times by holding symposiums and seminars. In 2018, the Financial and Economic Committee of the Provincial People’s Congress held two special meetings to invite relevant departments to conduct detailed research, and also invited relevant law firms to fulfill their social public welfare obligations and participate in legislative argumentation on behalf of consumers throughout the process. In October 2019, opinions were solicited from relevant departments and units again, and opinions were widely collected from the society through the portal website of Henan Provincial People’s Congress, and the Regulations (Draft for Comment) were further revised and improved, forming the Regulations (Draft for Review).
On June 3, 2020, the 18th meeting of the Standing Committee of the 13th Provincial People’s Congress deliberated and passed the Regulations, which were decided to come into force on January 1, 2021. Our province is the fourth province in China to complete the legislation of local telecommunications industry after Jiangxi, Liaoning and Hunan provinces.
III. Main contents of the Regulations
The Regulations consists of seven chapters and sixty-three articles, including general principles, telecom planning and construction, telecom market management, protection of users’ rights and interests, telecom security, legal responsibilities and so on. The formulation process of "Regulations" will run through the legislative work with the concept of people-centered, with the value orientation of protecting the interests of telecom users as the guide, balancing the rights and interests of all parties, and solving some outstanding problems in the development and management of Henan telecom industry.
(A) establish the strategic position of telecommunications infrastructure
According to the "Broadband China" Strategy and Implementation Plan, Article 6 of the Regulations stipulates: "Telecommunication infrastructure belongs to strategic public infrastructure and is protected by national laws. No unit or individual may damage or endanger the safety of telecommunications infrastructure, and may not prevent or hinder the construction of telecommunications infrastructure in accordance with the law. " This regulation highlights the determination of the "Regulations" to strengthen the construction and protection of telecommunications infrastructure, and strives to break all kinds of problems existing in the construction and protection of telecommunications infrastructure in our province through legislation, so as to provide support for fully promoting the development of new infrastructure such as 5G.
(B) pay attention to strengthening the protection of the rights and interests of telecom users.
At present, the telecom market infringes on the legitimate rights and interests of consumers to varying degrees. In order to effectively solve the concerns of the masses and protect the vital interests of telecom users, the Regulations focus on the protection of users’ rights and interests, and make clear provisions on telecom users’ right to choose services, commercial information and harassing calls, cracking down on telecom network fraud, complaints and appeals.
In terms of the free choice of telecom users, Article 28 of the Regulations clearly stipulates that "telecom users have the free choice of telecom business operators, and telecom business operators shall provide users with port number transfer services in accordance with relevant regulations. Developers and owners of civil buildings shall provide equal access conditions to telecom operators and shall not sign agreements with telecom operators with exclusive terms. " In this regard, Article 57 of the "Regulations" sets penalties. For those who violate the provisions of Article 28 and refuse to make corrections, the developers or owners of civil buildings and telecom business operators will be fined 200,000 yuan to 1 million yuan respectively.
On the issue of commercial information and harassing telephone calls, Article 32 of the Regulations stipulates: "No unit or individual may send commercial information to telecom users without their consent. Telecommunications business operators should strengthen the construction of technical means, improve their identification and interception capabilities, and increase the governance of commercial information, spam and harassing calls. "
In view of the issue of telecom charges, the third paragraph of Article 30 has been added: "The free trial telecom services provided by telecom operators shall not be converted into charging items after the trial period expires without the confirmation of telecom users." The provisions of Article 40 and Article 41 have been added, and it is clear that telecom business operators should regularly test the billing system and announce it to the public; When the abnormal telecom charges of telecom users are found to be more than three times the average telecom charges in the previous three months, they shall promptly inform the telecom users and take measures to help them find out the reasons.
In addition, according to the Constitution of People’s Republic of China (PRC), the Cyber Security Law of the People’s Republic of China and other regulations, the Regulations also make strict provisions on the restrictions on the collection of users’ messages by telecom operators and the protection of users’ personal information, mainly embodied in Article 35.
(C) increase telecommunications security.
The fifth chapter of the Regulations is telecom security, which includes two aspects: telecom network security and telecom facilities security. In terms of telecom network security, the Regulations put forward specific requirements for telecom operators, stipulating that telecom operators should fulfill their security protection obligations in accordance with the requirements of the national network security protection system, strengthen the design, construction and operation of telecom network security facilities, and formulate emergency plans for network security incidents. In terms of the safety of telecommunication facilities, the Regulations stipulate that a safety protection zone should be set around telecommunication infrastructure, which clarifies the behaviors that are strictly prohibited in the safety protection zone, lists the prohibited behaviors that endanger the safety of telecommunication infrastructure, and stipulates the legal consequences that endanger the safety of telecommunication facilities. In addition, the "Regulations" also stipulates the main body responsible for the security protection of telecommunications infrastructure and the solutions to possible problems when repairing telecommunications infrastructure.

The "Regulations" clarify that telecommunications infrastructure belongs to strategic public infrastructure, and solve the existing problems such as insufficient network coverage, difficulty in approving the construction of telecommunications facilities, difficulty in site selection, difficulty in entering the market, and difficulty in transforming power supply through legislation, which provides legal protection for accelerating the construction of new infrastructure such as 5G. The Provincial Communications Administration will conscientiously perform its industry management functions, focusing on the implementation of the Regulations from the following aspects.
The first is to strengthen planning and guidance. At present, the Provincial Communications Administration has organized cities under the jurisdiction of provinces and counties (cities) directly under the jurisdiction of the province to prepare special plans for communications infrastructure and the construction and development of 5G base stations, and completed the approval procedures according to procedures. The "Regulations" clarify that supporting telecommunications facilities in public service places, institutions, enterprises and institutions, large shopping malls, commercial buildings, hotels, residential quarters, scenic spots, parks, airports, stations, ports and other areas should be designed, submitted for approval, constructed and accepted at the same time with the construction project, and the required expenses should be included in the construction project budget. In combination with the reform of the examination and approval system for engineering construction projects, our bureau will further strengthen the implementation of national mandatory provisions such as Code for Design of Fiber-to-the-Home Communication Facilities in Residential Areas and Residential Buildings and Code for Design of Integrated Wiring Systems, so as to ensure the synchronous construction of telecommunication pipelines within the project construction land and supporting telecommunication facilities such as telecommunication pipelines, wiring facilities and equipment rooms in buildings. Coordinate relevant departments or units to reserve supporting communication facilities for roads, bridges, tunnels, rail transit, urban underground utility tunnel and other projects, and actively promote the opening of the sites of public places, public facilities and public institutions invested by the government.
The third is to strengthen the protection of telecommunications infrastructure. Implement the system of demarcating telecommunication infrastructure safety protection zones, and organize provincial basic telecommunications companies and provincial tower companies to further clarify the scope of protection zones and set up warning signs around three categories: overhead facilities, ground facilities and buried facilities. Strengthen the civil air defense, physical defense and technical defense of communication infrastructure to ensure the safe and smooth communication network. In the early stage, harassing phone calls and junk information flooded, which made the majority of telecom users very disgusted, and there was a strong voice from all walks of life calling for strengthening governance. To this end, in accordance with the work deployment of the Ministry of Industry and Information Technology, in September 2018, the Bureau jointly formulated and issued the Special Action Plan for Comprehensive Remediation of Harassment Phones in Henan Province (Yutong Bureau [2018] No.45) in conjunction with fifteen departments and bureaus including the Provincial Public Security Department, the Industrial and Commercial Bureau, the Education Department, the Housing and Construction Department, the Banking Regulatory Bureau and the Securities Regulatory Bureau. The action plan defines the control measures from seven aspects: strengthening the management of voice line and code number resources, improving contract constraints and real-name registration, comprehensively standardizing marketing outbound calls, cleaning up harassing software, strengthening the management of line resources and the traceability of calling number authentication, improving interception disposal, and enhancing the ability of reminding and early warning, so as to standardize the marketing behavior of key industries. At the beginning of 2019, our bureau also formulated the "Work Plan of Special Action for Comprehensive Remediation of Harassment Calls in Henan Information and Communication Industry", which further clarified the specific measures for comprehensive remediation of harassment calls in the information and communication industry.
At the same time, in order to unblock the channels for reporting complaints, our bureau accepted reports from the public through the 12321 Reporting Center, relying on websites, telephones and reporting apps, and established a mechanism for reporting, verifying, distributing and feeding back harassing calls. According to the report, we will quickly transfer it to the office for investigation and urge the relevant companies to deal with it in time.
In order to stop the interception of harassing calls and spam messages in time, our bureau organized three basic telecom operators to upgrade their network platforms again, improved the management of user contracts and conducted a comprehensive inventory of communication resources. According to statistics, since 2019, our province has shut down more than 1,000 illegal voice lines and 400 numbers, prevented more than 290 million spam messages from being sent, intercepted more than 830 million illegal calls, and shut down more than 30 short numbers with 95 switches. The three operators also provide a "call rejection" service, with which users can set up their own interception of harassing calls. Now, 4.1 million users have registered to use it, and the average daily interception volume exceeds 2 million. After comprehensive management, the number of harassing calls and spam messages reported by users has dropped significantly.
After the regulations are officially implemented on January 1 next year, our bureau will continue to organize basic telecommunications enterprises to further improve the long-term mechanism and continue to strengthen standardized management. First, continue to strengthen technical control. In calling number authentication, call tracing, network interception, warning and other aspects, the system functions are constantly updated to enhance the preventive ability. Second, continue to strengthen the management of business resources. Further strengthen the qualification verification and daily behavior supervision of new network users; Regularly check the use of voice line and code number resources; Close all kinds of special lines used illegally in time; Strengthen the contract constraints of telephone users. Third, continue to strengthen the tracing of problem clues, track and analyze them in time and dispose of them quickly, and close the sources of harassing calls and spam messages from the source.

As the administrative department of information and communication industry in our province, under the correct leadership of the Ministry of Industry and Information Technology, the provincial party committee and the provincial government, the Provincial Communications Administration has continuously strengthened the safety supervision of telecommunications networks and Internet networks, earnestly performed its duties, guided the basic telecommunications enterprises and Internet enterprises in the province to do a solid job in network and information security protection, and comprehensively improved the security level of public Internet networks in our province.
The first is to strengthen system construction. Conscientiously implement the Network Security Law, strictly implement the relevant regulations of the Ministry of Industry and Information Technology, the provincial party committee and the provincial government, and combine with the reality of the information and communication industry in our province, have successively formulated and promulgated a series of institutional measures, such as network security threat monitoring and disposal, network security level protection, network security emergency management, data security protection, etc., which provide institutional guarantee for the network security management of telecommunications and the Internet.

The third is to strengthen the construction of talent team. In order to speed up the training of network and information security talents in our province, our bureau has held the "Tianan Cup" vocational skills competition for network security administrators in Henan Province for three consecutive years since 2018, and selected outstanding players to form a 100-member team of "security guards" in the information and communication industry in Henan Province, providing talent support for doing a good job in network security in the information and communication industry. It should be said that this chapter is the biggest highlight and innovation of the regulations, which truly embodies the principle of adhering to the people-centered principle. Over the years, the Provincial Communications Administration has always been focusing on the people, supervising and guiding telecom operators to improve service quality and safeguard users’ legitimate rights and interests. In particular, this year, our bureau has made great efforts to do several tasks to earnestly safeguard the interests of the people:
The first is to standardize the service behavior of port number transfer. Formulated and promulgated management regulations, clarified the work requirements of "nine no’s and ten must’s" and more than 20 implementation rules, ensuring that the port number transfer network was carried out as scheduled. In view of the chaotic phenomena such as irregular service and vicious competition in the initial stage of the work, the company has successively imposed administrative penalties for 3 times and informed criticism for 5 times, conducted administrative guidance and interviewed more than 40 people, and imposed administrative sanctions such as demerits and warnings on the responsible persons of relevant companies and disciplinary sanctions for 16 people. At the same time, organize daily unannounced visits and inspections, strengthen business training, guide companies to rectify in time, and the service of port number transfer is becoming more and more stable. In November, the number of complaints from users about port number transfer decreased by more than 85% year-on-year.
The second is to actively carry out the rectification of the wind and improve the service level. Our bureau regularly holds regular meetings on markets and services, guiding and urging companies to effectively regulate market competition behavior, and timely handling and solving hot issues reflected by users. All user complaints, letters and visits received by our bureau are settled in time within the prescribed time limit. In response to hot issues such as spam messages and harassing phone calls, a number of government departments have jointly carried out governance. It is strictly forbidden for basic telecommunications enterprises to open code numbers for subjects who are not allowed to use telecommunication network code numbers, focusing on investigating violations such as unauthorized transfer of rental or disguised transfer of rental code number resources. Administrative guidance was given 14 times throughout the year, and rectification was ordered 13 times. The number of problems reported by users continued to decline. The complaint rate of millions of users in the province decreased by 40% year-on-year, and the complaint rate of service problems affecting users’ perception decreased by 57% year-on-year. The satisfaction of telecom users in our province has exceeded 80 points for five consecutive years, reaching a satisfactory level.
The third is to improve the protection of personal information and prevent and control telecommunication network fraud. Make full use of technical means to prevent fraudulent telephone calls and Internet fraud, and handle more than 550,000 fraudulent numbers and more than 60,000 fraudulent websites. In cooperation with the clean-up campaign, more than 5,200 illegal websites have been disposed of this year, more than 400 unregistered websites have been closed, and more than 10,000 illegal websites have been closed by access service enterprises, effectively purifying the network environment. Earnestly implement the real-name registration of telephone users, and further standardize the electronic channel access process. Cooperate with the Ministry of Industry and Information Technology and China Information and Communication Research Institute to carry out APP testing, and stop APP from illegally collecting personal information and other violations.
The telecommunications regulations to be implemented soon set up a special chapter on the protection of users’ rights and interests, which contains 14 clauses, which is the one with the most clauses in the seven chapters of the regulations. The second is to effectively protect users’ personal information and strengthen the comprehensive rectification of mobile application apps. Carry out special rectification of APP, comprehensively rectify the situation that APP expands the scope of user information collection and abuses user information, and stop collecting user information at will; Seriously investigate and deal with illegal issues such as spam messages and harassing calls, close illegal numbers and lines, and provide users with a normal and quiet working and living environment.
The third is to promote industry self-discipline and strengthen market supervision. Strengthen the supervision of market competition behavior, guide and urge companies to carry out rational competition. In view of unfair competition behaviors such as vicious competition on campus, deliberately obstructing the transfer of numbers to the internet, building monopoly, etc., once found, it will be severely punished and the relevant responsible personnel will be held accountable. Establish and improve the credit mechanism, credit points, as well as illegal behavior files, bad lists and untrustworthy lists, so that enterprises can violate the rules and be restricted everywhere.
